Server use
Centurian.net reserves the right to refuse service and/or access to its servers to anyone.
Centurian.net do not allow any of the following content to be stored on its servers:
Illegal Material – This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any UK legislation.
Adult Material – Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of Centurian.net.
Warez – Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide “links to” or “how to” information about such material.
Support
We will endeavour to provide a continuous high quality service. If you experience problems with your service, you should contact us at the earliest opportunity.
Please note we may require suspension of some of our services for short scheduled periods to carry out maintenance or repair to our services.
Reselling of services
All hosting accounts are to be used by the primary owner only, and do not allow the holders to resell, store or give away web-hosting services of their website to other parties.
Web hosting services are defined as allowing a separate, third party to host content on the owner’s web site. Exceptions to this include ad banners, classified ads, and personal ads.
Unlimited use policy
High bandwidth usage: Centurian.net offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, Centurian.net may find a customer to be using server resources to such an extent that he or she may jeopardise server performance and resources for other customers. In such instances, Centurian.net reserves the right to impose the High Resource User Policy for the consideration of all customers.
Database usage
If you exceed the limits on our database products (MS SQL and MySQL) then we will automatically charge you for the additional space you use at our current prices. For example if you have a 150MB database and 200MB is in use at any point during a month then we will charge for the extra 150MB (currently £75 for MySQL) in that month.
High resource use policy
Resources are defined as bandwidth, processor utilisation or disk space.
Centurian.net may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available, Centurian.net reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Centurian.net continues hosting the website for an additional fee.
Payment policy
Accounts remaining unpaid after 30 days from the date of the invoice will be deemed to be in default until such time as full payment is received. Centurian.net will at its discretion, disable or remove websites and other files for any client in default of payment. Such disabling or removal of material will not relieve clients of their obligation to pay any outstanding charges. For all accounts in default, Centurian.net reserves the right to charge incremental interest at the rate of 1% per day of the incrementing outstanding balance. For all accounts in default, Centurian.net may send reminder letters every seven days until such time as the debt has been paid. These letters may incur a charge of £10.
Cheque’s returned unpaid due to insufficient funds will incur a service charge of £25. If an account remains unpaid after 56 days of the date of the invoice, then Centurian.net will commence legal proceedings to recover the debt. The client will be held liable to all costs incurred by Centurian.net in recovering the debt.
Cancellation and refunds
Centurian.net reserves the right to cancel any service at any time. Hosting and promotion services are non-refundable. Web design costs may be refunded at Centurian.nets’ discretion and dependant upon work completed so far. If a customer contravenes Centurian.nets’ terms of service, a refund will not be issued in the event of a cancellation.
Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.
Cancellation of services, such as Centurian.nets’ hosting and maintenance of websites, must be requested in writing. Telephone or email requests for termination of services will not be accepted. Centurian.net will require a minimum of 7 days notice of termination. If for any reason (except breach of UK laws by the website owner) Centurian.net have to terminate a service such as hosting, we will give 7 days notice of our intention to terminate the account.
Once hosting and supplements have been configured and set up by Centurian.net, no hosting refunds can be issued.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Centurian.net harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Centurian.net, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Centurian.net against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with a Centurian.net server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from a Centurian.net server.
Disclaimer
Centurian.net will not be responsible for any damages your business may suffer. Centurian.net makes no warranties of any kind, expressed or implied for services we provide. Centurian.net does not back up your data/website unless it is placed on a load balanced server, and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, Centurian.net cannot guarantee to be able to replace lost data. It is the clients responsibility to keep backups of any web files, emails or databases. Centurian.net disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Centurian.net and its employees. Centurian.net reserves the right to revise its policies and terms at any time.
Quotations
Centurian.net will provide a full written quotation, free of charge, to include a full breakdown of costs and services. Payment will be required within 30 days of the date on any invoice issued by Centurian.net. If requested, quotations will include a timescale for development. All quotations will be valid for one month from the date shown on the quotation.
Single website design
Upon receipt of the signed contract, Centurian.net will invoice for any initial set up costs plus half of the total remaining costs. Included with the initial invoice, Centurian.net will acknowledge receipt of the contract and confirm the completion date. The completion date will be the date that the website will be posted onto the Internet. Upon receipt of the first payment, Centurian.net will then develop the clients website to the required specifications by the completion date. When the website has been published on the Internet, Centurian.net will invoice the client for all remaining costs.
Web site design and maintenance contacts
Upon receipt of the signed contract, Centurian.net will invoice for any initial set up costs and will acknowledge receipt of the contract. Centurian.net will then develop the clients website to the required specifications. There are no monthly plans, only annual.
If any meetings are required, Centurian.net will charge £60 per hour plus travelling expenses (if travelling by car the cost would be 90 pence per mile).
Supplying Information
The client will supply all textual information in either a text (.txt) or Microsoft Word (.doc) format. The client will supply any images, photographs or logo’s in either .gif or .jpg format. If the media is not over 4Mb in file size, Centurian.net will accept delivery via email at info@centurian.net. If any media is over 4Mb in file size, Centurian.net will only accept delivery by post, where the client will have transferred all relevant media onto a CDR.
Maintenance
Centurian.net undertakes to maintain websites at regular periods as agreed with the client, and to repair faults notified to us within 48 hours of notification being received by us.
Updates
Centurian.net will undertake to update websites as agreed with clients. Centurian.net reserves the right to delay or refuse updates that are outside the agreements. For monthly contracts, Centurian.net will charge an additional £50 per hour per 5 web pages (no more than A4 in size), if the updates are outside the agreements, which were agreed by the client when signing the quotation (contract).
Domain Names
Centurian.net make no guarantee that the clients desired domain name(s) will be available, but will notify clients of any suitable, available alternatives. All clients holding a domain must comply with the Terms and Conditions of the authority responsible for regulating the respective domain. Nominet UK regulates the .uk top level domain, and their Terms and Conditions can be obtained from http://www.nic.uk/. The authorities responsible for regulating domain registrations charge an annual fee to ensure the domain name is retained by the holder and cannot be registered by someone else. Non-payment of the annual fee will result in the domain name being released as available to other users. Centurian.net charges a fee for the registration of the domain name for a period of two years. This fee includes the fees to the regulatory authorities. In all circumstances, the holder of the domain name will be responsible for ensuring renewal fees are paid. Centurian.net will accept no responsibility for the loss of domain names or websites due to a client’s failure to pay the required fees.
Copyright
The copyright for all material provided by the client, such as graphics, photographs, logos and text, would remain with the client. The client will give Centurian.net the right to publish and use this material for the purpose of website construction. The copyright for all material provided by Centurian.net, such as graphics, photographs and text, will remain the property of Centurian.net until such time as payment has been made in full. Centurian.net will grant the client permission to use this material pending payment. Upon receipt of payment, Centurian.net will transfer copyright to the client.
Clients must obtain permission from Centurian.net to use any material, which is copyright of a third party. The client will agree to indemnify and hold harmless Centurian.net from all claims resulting from the client’s negligence or failure to obtain permission to use such copyright material.
Promotion
Centurian.net will undertake to promote client’s websites as agreed with the client. Whilst Centurian.net will make every effort to promote the websites as effectively as possible, we cannot guarantee a high position in any search engine results.
Hosting Services
Centurian.net reserves the right to suspend or cancel a customer\’s access to any or all services provided by Centurian.net, where Centurian.net decides that the account has been inappropriately used. Centurian.net reserves the right to refuse service and /or access to its servers to anyone.
Centurian.net offer unlimited web space and bandwidth with some account types. By this, we mean unlimited space for legitimate web site content and bandwidth for visitors to view it. All files on a domain must be part of the active website and linked to the site. Sites should not contain any backups, downloads, or other non-web based content. We will treat all password protected archive (e.g. zip and rar) files as unacceptable. MP3 and other large multimedia files are not web-based content. Centurian.net offers a streaming media service for this type of content.
Scripts on the site must be designed to produce web-based content, and not to use the server as an application server. Using the server to generate large volumes of email from a database is an example of activity that is not allowed. Scripts should not attempt to manipulate the timeouts on servers. These are set at the present values to ensure the reliability of the server. Sites that reset these do so because they are resource intensive, and adversely affect server performance and are therefore not allowed.
Centurian.net will disable any domain that fails to adhere to the following criteria as soon as we are made aware, in line with current working practices:
- The primary purpose of any site must be to provide web-based content to viewers. Files on the site must be linked to the web site.
- The primary purpose of any script must be to produce a web page. Scripts that send a single email based upon user entered information, or update a database are acceptable. Scripts that send bulk email or perform processor intensive database processes are not allowed. All outgoing mail is monitored and filtered.
- Sites must not contain Warez, illegal or copyright material. The onus is on you the customer to prove that you own the rights to publish material, not for Fasthosts to prove that you do not.
- Sites must not contain MP3 files, as they do not represent active web content. Other multimedia files are acceptable if they are configured to stream to the client rather than download (Please see section 1.2 of this policy).
- Sites must not contain password protected archive (e.g. zip or rar) files, or data back ups.
- Sites must not contain pornographic or other lewd material. Adult Material includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of Centurian.net.
- Sites must not use excessive amounts of server resources. These include bandwidth, processor utilisation and/or disk space. Please see the ‘High Resource Use Policy’ in the General Terms and Conditions.
- Sites must not contain scripts that attempt to access privileged server resources, or other sites on the same server.
If Centurian.net identify a mailbox or domain that is causing problems; we will either remove the offending mailboxes or change their settings to resolve the issue. In extreme cases, we will disable email or suspend all services to the domain as appropriate.
Common issues that cause problems are:
- Where a mailbox receives large volumes of undeliverable email.
- Where mailboxes have forwarders set to other mailboxes where mail cannot be delivered.
- Where mailboxes have forwarders and/or auto-responders that generate circular mail loops.
You may not use Centurian.net Email services for any of the following:
- To send messages or communications, which are unsolicited, offensive, abusive, indecent or obscene.
- To send messages causing annoyance, inconvenience or anxiety to another user of the Internet.
- To send messages for the purpose of Fraud and/or with the intention of committing a criminal offence.
To prevent the sending of bulk unsolicited mail, SMTP traffic to and from a server will be blocked in the following scenarios:
- Where we identify a server that has an open mail relay.
- Where a significant volume of mail is sent from a domain in a 10-minute period.
- Where we have received significant volumes of complaints concerning unsolicited mail originating from a Centurian.net hosted server.
To prevent Centurian.net IP Addresses being blocked by IP Address blocking, a domain held on Centurian.net servers may be disabled:
- Where we have received significant volumes of complaints concerning unsolicited mail originating from or unsolicited email being sent to promote sites being hosted on a Centurian.net server.
General
Centurian.net have a Police Liaison function and we are committed to assisting, and cooperating with, all law enforcement and government agencies in helping to reduce Internet Crime.
Centurian.net will suspend access to an account which:
- Contains invalid or fraudulent details.
- Initiates a payment card chargeback.
If Centurian.net disable a site or server, we will:
- Send an email to the account administrator, informing them of the suspension – please ensure you use an email address that will be unaffected by any suspensions, to ensure that you are immediately made aware of any changes in your account status.
- Provide follow up correspondence during office hours from our Abuse Department, detailing the reasons for the suspension and what actions, if any, the administrator should take to rectify the situation.
- Not re-enable any domain or server that has previously been suspended for similar abuse.
- Pass the account to the appropriate department to resolve any outstanding issues such as account balance or closure.
For less serious cases, such as email problems, the Abuse department will contact you during office hours and inform you of any changes made to your account and the reasons for those changes.
If an action is taken against a site or server, you must correspond only with our Abuse Department on abuse@centurian.net. No other departments are able to discuss the details of an Abuse Investigation.
Restoration of any and all services suspended during an Abuse Investigation will be considered on a case-by-case basis.
